700 Bags of groundnuts were sold by a person.
The bags were identifiable with marks, were lying in the warehouse. Unknown to the seller, 109 bags were stolen. Later, the seller delivered 591 bags of Groundnuts to the buyer. Can the buyer void the contract ?
I would be grateful if I ciould get an exact answer .

Whether for the goods stolen there is a police complaint lodged and you have got an reply from police that it is not traceable.
If these two documents were there then you can void the contract, stating the reasons and can deliver the balace 591.
If you are unable to produce these 2 documents then you have to arrange for same quality of 109 bags or should re-imburse the loss happend to him.
