Can we set off unabsorbed depreciation with short term capital gain

i dont think it is allowed. please refer Chattisgarh High Court judgment in the case of Jyoti Straw Products Private Limited (https://www.cghighcourt.nic.in/courtJudgementandAFR/2013/May/Taxcase2006of10.pdf)
