Trust

This query is : Resolved

31 July 2011 Dear Expert,

I would like to know about the initial steps to be undertaken to constitute a charitable trust in Kerala. The stamp papers, minimum trustees required. Could you please provide me a brief advice on the same? I would be highly obliged if you provide me a link to any of the websites to get an elaborate view.

31 July 2011 In kerala a trust can be formed in many ways. U can register a trust as a socity under Societies regn act 1860 with Dt Registrar or u can register a trust deed as a doc with sub-registrar under regn act 1908.Only one person is required to form a trust and he can be the trustee also. But a person cannot be a trustee and beneficiary at the same time.

01 August 2011 First of all you have to get the trust deed drafted and registered with the Charity Commissioner. In the trust deed you have to mention in the main clause the nature of your activities.

The minimum number of trustees should be 2. The corpus fund should not exceed 1000 otherwise you have to pay stamp duty on the said amount

02 August 2011 Sir,
Out of the above statutory acts which is the most beneficial one for the trustees? If the corpus fund is above 1 lakh then please explain how to value the stamp paper? I would like to have an explanatory detail on the same.
