To remove form 8 from index of charges

21 June 2013 hiiii there is a query:
The company has created charges in the year 1985, 1986 and 2003 respectively and duly satisfied them in the balance sheet of the Company but did not filed form 17. What is the remedy??????

21 June 2013 Required a petition to be filed with Regional Director, Ministry of Corporate Affairs and earlier the same was required to be made to Company Law Board for condonation of delay under Section 141 of the Companies Act, 1956.

21 June 2013 According to section 135 of the companies act 1956 after satisfying the charge the borrower company hsve to file form 17 within 30 days form the date when the bank issued NOC. Being very late, the borower company have to file Petition to Regional Director, Ministry of Corporate Affairs through practising professionals.

For the above filing ,documents required are given below in seriatim:-
i). MOA & AOA of ye company.

ii). Form 8 and Form 17 and its receipt.

iii). communication from ROC for delayed filing of form.

iv). Stamp Paper of Rs.20/-

v). MCA fee Rs.1,000/- for e-filing form 24AAA.

vi). MCA fee Rs.200/- to Rs.500/- (depending on the authorized share capital) for e-filing application in form 61.

vii). Board Resolution authorizing filing of Form .
