WHETHER TDS IS APPLICABLE ON REIMBURSEMENT OF EXP. TO CLEARING & FORWARDING AGENT AT THE TIME IMPORT ?

If separate bill is raised for reimbursement of expns and for fee of C & F agent, then TDS u/s194C not applicable in case of reimbursement of expns but if a consolidated bill raised for fees as well as expenses reimbursement then entire amount subject to TDS ( ITAT in ITO V Dr.Willmar India P Ltd [2005]3 SOT 71 )
