TDS return when PAN not available

26 March 2008 We are deducting tax at source but PAN Nos of most of our deductee is not there. Hence e filling computer is not allowing us to file T.D.S. Return. What is our fault and what is the solution

26 March 2008 As per the circular issued on 12Feb2008 No.402/92/2006-MC (10 of 2008), you should have atleast 90% deductees PAN while filling ETDS return. No problem just mentioned PANAPPLIED, PANNOTAVAI. But afterwards you will receive the letter from NSDL to correct the return, meand while force deductees to apply for PAN & get the PAN of deductees.

26 March 2008 you have to collect their PAN no.
there is no other option.

26 March 2008 If I write PANAPPLIED IN PLACE OF PAN NO WILL NOT IT BE A CASE OF QUOTING WRONG PAN NO AND CONSEQENT PENALTY MAY BE LEVIED???

26 March 2008 Ask the deductees to apply for PAN.

Otherwise, tell them that they may be liable to penalty(Not in reality. but there is no other way)
