I will firmly advise you to request the employee to apply for PAN. else claiming tds credit will be an issue.
if the PAN is not made available, you need to ensure that TDS deducted is not less than 20%.

you still have time till 15th May...normally PAN can be procured in 2 weeks..so ask them to apply immediately
