21 March 2011 An employee joined the company in the last quarter...He was previously working as a consultant and he has other income but he has not declared the income to the company as he is not sure about the approximate amount. He is requesting the employer to deduct tax at the highest tax slab. Can the employer deduct TDS on salary at a higher rate based on the requisition from the employee. What is the procedure if any?

21 March 2011 The employer cannot deduct tax at higher rate upon request of the employee with out furnishing the details of other income.

21 March 2011 Non compliance of section 192(2B)by the employee does not permit the employer to deduct tax at higher rate.
