Dear All,
Please tell me whether TDS need to be deducted on food bill received from restaurant on which they have also charged service tax @ 4.944% i.e 40% of 12.36%. And if it need to be deducted then under which section it need to be booked 194c,194j of 194I.if possible please provide the link of any notification which support your view and explain the logic

if you pourchase not regularly food then no tds
but when you organise party then you deduced tds u/s 194 C Deducted 1%/2% TDS
but when you organise party then you deduced tds u/s 194 C Deducted 1%/2% TDS

Can you give me any link of any notification or judgement which can support the view that TDS need not be deducted on food bill as the same has come under perview of service tax from 1st april 2013 as the govt is charging 4.94 of total bill amount as charges for facilities!
