05 February 2014 My Tax TDS deducted under under 194H for FY2012-13 But not deposited by deductor
They are proudly said not deosited what can You do, they also said in Tax provision only you can go by high court case is deductee right ?
IS the awre about loom hole about IT act
May i know is any other way to complaints about deductor who play with My money that i can claim if the deosited in I T

05 February 2014 Dear Manoj,

Your concern is very valid and worry some.

I would advise you to keep all such evidences which proves that your TDS has been deducted and all the conversations which states that deductor has deducted TDS but not deposited.

As per recent judgment of High Court, on the basis of sufficient evidences you can take credit of TDS even tough deductor has not paid it.

Further action will be taken by IT Dept on the deductor.

Hence I advise you to take credit of TDS.

06 February 2014 make a complaint to ITO-TDS of deductor with evidence that tds was deducted but not deposited

06 February 2014 File your Individual IT return by quoting Dedcutor's TAN as TDS Deducted by him and after that Department will give notice to the Deductor. But maintain all the available proofs about your TDS.
