02 November 2010 our company is getting transport service from one famous company. but the transporter is registered under courier service for service tax purpose.from our company prospective we are account these expenses under transport charges.
My query is whether we have to deduct TDS or Not for this purpose since TDS is exempt for transporter ( Registration under courier service as per service tax as any impact for TDS deductability)

02 November 2010 You need not deduct TDS if it falls with the perview of section 194C (6)

02 November 2010 TDS is based on nature of transaction and not on the basis of other person.

based on that TDS need to deducted




03 November 2010 From 01/10/2009 all person engaged in plying, hiring or leasing of goods carriages can avail the benefit of non-deduction of tax at source on payments made to them, without reference to their status or to the number of goods carriages owned by them if the transporter furnished his permanent account number (PAN) to the person paying or crediting such sum. Accordingly, If your transport service provider fulfills the above conditions then no TDS is required.
