if an office order a to hotel for lunch to their employee and different occasion . the payment made to hotel is exceed 75000 per year. the hotel person came in office campus prepared some item & served food also. is the payment made to hotel is liable for tds

from the safer side you must deduct TDS
Same is happening in my company and we are deducting TDS on Contract. because we had given him contract of prepration and servicing of food to our employees.

but if the hotel is giving bill including all taxes, not separate amount of service tax, & they are refusing to deduct the TDS as they say no other company is deducting TDS of supply of food. what is the correct thing to do.

In my view you have given the contract to the hotel for preparation and service..this inculdes service part also.. so you must deduct tds on them...
