Taxability of medical expenses

26 March 2013 My client, a bank employee has incurred Rs.120000 on medical treatment for placing pacemaker for his mother. The employer has reimbursed Rs.80000. What will be the tax implication...???

26 March 2013 If the treatment expenses incurred for the above purpose is covered under RULE 11DD specified diseases and the monther is depended on your client and such diseases effect is 40% or more then eligible to claim deduction u/s80DDB upto maxium of Rs.40,000 by producing medical certificate from the Government Hospital.

Please go through the Secion 80DDB of income acr and RULE 11DD of income tax rules for clear and better understanding of eligibility of deduction and requirements to get deduction etc...


The RULE 11DD covers the following diseases to the the eligibility of section 80DDB

i) Neurological diseases:
a) Dementia, b) Dystonia Musculorum deformans, c) Motor Neuron Disease, d) Ataxia, e) Chorea, f) Hemiballismus, g) Aphasia, h) Parkinsons Disease

ii) Malignant Cancers
iii) Full Blown Acquired Immuno - Deficiency Syndrome (AIDS)
iv) Chornic Renal Failur
V) Hematological Disorders:
a) Hemophilia, b) Thalassaemia

If the treatment expeses incurred by your client covers any of the above specified diseases and such diffency is 40% or more then he eligible for deduction u/s 80DDB by producing certificate from Government Hospital. For certification details etc... please refer RULE 11DD it will gives on which form you have to take certificate etc...
