31 December 2014 I had filed the return of my firm for A.Y.2012-13. The operations of the firm seized to exist from 30/06/2011. After that date no operations took place.

Hence I did not filed the Return for A.Y 2013-14 & A.Y.2014-15.

Moreover I did not surrender the PAN Card.

Today I got the reminder from Income Tax dept, to file the Return for A.Y 2014-15.

What should I do now:
1) Should I file Returns for above period?
OR
2) Should I surrender the PAN without filing the return? Would this option attract any consequence?

31 December 2014 you have to file the return of every year . now you can file the return of F year 2012-13 and 2013-14.

and surrender the PAN with dissolution deed of the firm.

03 January 2015 But the dissolution deed is dated 28/06/2011. Partnership Firm seized to exist from that date. So how can i file the return when partnership firm did not exist.

26 July 2025 This is a common issue with firms that have ceased operations but have not formally closed their tax registrations.

### Hereโ€™s what you should do:

1. **File the pending returns for AY 2013-14 and AY 2014-15**
Even if the firm ceased operations on 30/06/2011, the Income Tax Department requires return filing for those years because the PAN is still active. In these returns, you should clearly state that the firm was **dissolved on 30/06/2011** and had **no income or operations thereafter**.

2. **File a copy of the dissolution deed along with the return**
Attach the deed or proof of dissolution of the firm to support your claim that the firm ceased to exist.

3. **After filing pending returns, surrender the PAN of the firm**
Once the returns are filed, you can apply for surrender of the PAN by submitting a request to the Income Tax Department along with the dissolution deed.

---

### Why this procedure?

* **Filing returns** ensures the department has a proper record and does not treat the firm as non-compliant.
* **Surrendering PAN without filing returns** can attract notices, penalties, or prosecution for non-filing.
* The department may reject surrender requests if returns are pending.

---

### In short:

* File the returns for the years required with nil income and dissolution proof.
* Then submit a formal surrender application for the PAN.

---

If you want, I can help draft the return explanation or surrender application. Would you like that?
