15 October 2010 What is the time limit for sending application & Original COP to ICAI?

I am holding COP. Want to surrender from Sep. 26, 2010 (Sunday). But I am in Mumbai & script of COP is in Udaipur. I will be in Udaipur on Nov. 06, 2010.

What is the best way....Pls. guide.

15 October 2010 Requested to see the following provision of ICAI.
The Certificate of Practice of a member will be cancelled on receipt of a written request from him
under Regulation 10 (i) (iii) provided he has remitted the annual membership/ Certificate of
Practice fee for the relevant year.
(ii) In case the member desires to cancel Certificate of Practice from 1st April and the request is
submitted within 30th April, the Certificate of Practice of the member will be cancelled even
though he has not remitted the Certificate of Practice fees. However the member has to pay
the annual membership fee within the specified time. i.e. before 30th September.

I have paid the fees but I want to know is there any time limit for date of application to ICAI alongwith COP Certificate from date of COP surrender.

16 October 2010 Where a certificate of practice is cancelled, the holder of such certificate shall surrender the certificate to the Secretary within 15 days from the date of receipt of notice of such cancellation or from the date of the notification thereof in the Gazette of India, whichever is later, under sub regulation(3).

26 July 2025 Regarding **Surrender of Certificate of Practice (COP) with ICAI**, here’s what you need to know:

### 1. **Time limit for sending application and original COP:**

* ICAI **does not prescribe a strict time limit** from the date of surrender to submit the application and original COP.
* However, it is advisable to send your surrender application **as soon as practically possible** after your decision to surrender.
* The process is considered complete only after ICAI receives the original COP along with your application.

### 2. **Procedure and best way given your situation:**

* Since you are currently in Mumbai and the original COP certificate is in Udaipur, and you will be there only on **6th Nov 2010**, you should:

* Prepare and send your surrender application **by post or courier** immediately from Mumbai, mentioning the intended surrender date (e.g., 26th Sep 2010).
* Send the original COP certificate from Udaipur as soon as you reach there on or after 6th Nov 2010.
* You can send the original COP by **registered post or courier with acknowledgment** to ensure safe delivery.

### 3. **Effect of delay in submission of original COP:**

* The surrender of COP is considered effective only after ICAI receives the original certificate.
* Delays in submitting the original COP may **delay the official acceptance of surrender** but generally, ICAI is lenient as long as the process is followed in good faith.
