01 January 2016 Learned Expert, here i want to know about the stay order for the demand raised by Assessing Officer during the Scrutiny Assessment procedure and for that order appeal had been made.
in this i had already made a appeal before Commissioner of Income Tax (Appeal) for the Assessment Order issued by Assessing Officer. The Assessing officer had raise demand of Rs. 15 lac during the assessment and give the notice for demand u/s. 156. Here i want to know that is there any requirement to getting stay for the demand raised by assessing officer. if yes form which authority i have to apply for stay order of demand. and in which manner i have to make application for that

01 January 2016 1. File a stay petition before the CIT (Appeals).

2. File a letter before the ITO stating that an appeal and stay petition is filed before CIT (Appeals) and that recovery proceedings shall not be initiated before the disposal of the appeal or stay.
