Stamp duty on acquisition

Is there any stamp duty on acquisition by a Company of a society registered under societies registration act..
Indian Stamp act also west bengal stamp act do not mention on stamp duty on 'ACQUISITION'.

27 August 2025 The term "acquisition" is not independently defined or listed as a chargeable event in the Indian Stamp Act; what matters is the nature and form of the transfer, not the capacity of the entities involved.
If the transfer involves immovable property or other assets, the instrument of conveyance—like a sale deed, transfer deed, or assignment—would be chargeable as per the relevant entry (often under "Conveyance") in the Stamp Act.

Each State has specific rates and requirements for such instruments; however, there is no separate or additional stamp duty simply because the transaction involves a society and a company.

Personally I feel these are some grey arias in law, which may in latter cause litigation.

29 August 2025 Yes, if the transfer involves capital assets, you are required to register it, which is liable to stamp duty. The rates are state specific.
