set off of cvd against service tax liablity

12 August 2009 hello mr madhukar,

thanx for the answer. but my query is still unanswered. i have asked about the cvd paid on import of tradeable goods and not on capital goods.since we are also providing networking service on which we are paying service tax.can cvd be set off against service tax liablity.

13 August 2009 If you are charging service tax on the gross amount ( including the value of the traded goods) then it casn be said that the same are inputs used in providing the servcie and therefore the credit is eligible.
If you cliam a deduction for materials or pay on composition basis then the credit of CVD wouldnot be available.
