03 May 2012 Dear all,

We are signing a contract with Geneva based consulting firm to conduct a research for 3 countries i.e. 1) Bangladesh 2) Sri Lanka and 3) India.

The payment to be made to us is in Euros and come straight from Geneva.

My question is should we or not charge service tax on the amount?

03 May 2012 You need to wait till date is notified by the Central Govt of negative list, taxable territory etc. As of now, it will be considered as export of service. The delivarables are in the form of report to be sent to Geneva. This gives you choice not to pay service tax at the time of export and satisfy the other conditions set out.
