24 November 2013 ONE OF MY CLIENT (PVT. LTD CO.)PROVIDING CALL CENTRE SERVICES TO AUSTRALIA BASE OUR SISTER CONCERN' CUSTOMERS & RECEIVE PAYMENT IN FOREIGN CURRENCY

ONE DIRECTOR IN BOTH THE COMPANY (INDIAN & AUSTRALIAN) IS SAME PERSON.

PLEASE CLARIFY THE APPLICABILITY OF SERVICE TAX IN THE ABOVE CASE.

25 November 2013 Services provided by call centres to foreign clients who have no registered address, resident representative, liason office, etc in India are export of services.

It is not clear what the role of the Indian Director (common) is? Is he just a director of the company or does he conduct the business of the foreign company from his residence or office is India? Is he a resident representative of the foreign company. Without clarification of the Director's role and the use of his address in India by the foreign company - No correct and final answer can be provided to your query.
