Service Tax incase of letting out of commercial property..

24 October 2010 Dear Experts,
Please tell me whether service tax is applicable for letting out commercial property for rent.
Some people say the matter is still pending in Court. Whether we shall ask the clients to deduct service tax or not.

24 October 2010 In dispute as on today.Delhi HC decision in new case of HOme retail awaited.
a. If tenant paying collect and pay under protest to revenue
b. if tenant not paying and landord not interested in litgation at all, then pay under protest assuming amount recioved is includive of ST.
c. If tenant willing for legal resolution take underttaking from the teant that he would pay with interest and intimate dept why you are not paying.
