17 April 2015 All dear sir , we provide cab service to co. like HSCL , mittal if any party says don't charge service tax as they will pay then in this case should i charge service tax or not ?

18 April 2015 Dear Mr.Prakash,

If yours is a proprietory firm / partnership firm, the service tax is to be paid by the recipient unit under Reverse Charge Mechanism vide Notifn.No.30/2012-ST dt.20.06.2012 (Sl.No.7). Hence, you have to bill the amount for the service rendered and also mention that service tax to be paid by the recipient of the unit.
