Service tax applicability -cons. fee remitted outside india

05 March 2013 Hi Friends,

My querry is relating to Service Tax. I want to know details regarding applicability of Service Tax in relation to Consultation fees remitted outside India in connection with Installation of Imported Machinery by Manufacturing Company ( as a receipent of Service.)

Can anybody brief me about the relevant notification & w.e.f from which date Service Tax under this catagory is applicable?

05 March 2013 Yes, Service tax is applicable. Pls refer the place of provision of service Rules, 2012 Notification No. 28/2012 - ST, Dated 20.6.2012. Rule 4 and also Refer CBECs Guidance Note No.5.4. Applicable w.e.f. 1.07.2012.

I want to know one more thing i.e. w.e.f. which date Service Tax under this catagory is Applicable?

Is there is any specific notification with states applicability in this regard. If yes then please kindly let me know.

05 March 2013 agreed with expert.

The service tax is applicable to services provided on or after 16.8.2002 and any payment made for the services provided prior to this date will not liable to tax even though payment is made on or after the 16.8.2002.
