06 June 2008 I have a query regarding application of Service Tax Provisions in case of person engaged in providing service of painting of walls etc. for advertisement and also construction of buildings for office and residential use of employees of a particular organisation.Can he raise one bill for the same.
Please clarify under which service it will fall and whether there is any exemption in respect of construction of residential houses for employees.

07 June 2008 It is a works contract service.

One bill for both services can be raised.

Service upto Rs. 10 lakhs is exempt in the first year. Once you cross 10 lakhs, you have to collect and pay ST.

09 June 2008 I am not sure about of taxability of paintig of walls for advertisement. It does not seem to be a taxable service.

Construction of buildings .. fall under Works Contract Service. Tax @ 4%, if composition scheme is opted. Vat charged in the bill will not be included for calculation of taxable value.
