28 January 2010 Dear Friends,

Please let me know whether the sale of software is liable for both VAT & ST.

Can I split the bill into two as Sales of CD and Development and Installation of Software.

Please quote the relevant case laws / section underwhich the same is argued.

29 January 2010 Soft ware is a goodsas per Famous Tcs case and liable to vat and cst. In my opinion, you cannot spilit the bill into two as you are selling software. refer Tata consultancy servicesvs state of Andhra Pradesh(1997)105 STC 421 (AP)
