Rule 2d(1) identical goods

sir.,
as per rule 2 d(1) goods can be called identical goods if produced by the same person who prodced the goods or WHERE NO SUCH GOODS ARE AVAILABLE GOODS PRODUCED BY THE DIFFERNT PERSON ..
so. sir i want to ask even if that person who had produced the identical goods ( not the original exporter) had not produced the goods under same brand name of that original exporter .,, then whether the goods produced by that person(not being the original exporter )are continue to be identical goods?
