11 September 2012 Sir,
We have a tax audit of a proprieotship concern, the issue is proprietor is expired during the financial year 2011-12(Nov-2011). How can we file IT Return for A.Y.2012-13?
Whose PAN can be used?
Advance tax paid by using the OLD PAN can be treat as advance tax?
Who will be the signing person?
Who will take DSC?

11 September 2012 1. The return will be filed by the legal heir in the name of the deceased.

2. The PAN of the deceased will be mentioned in the return.

3. The legal heir shall obtain a DSC in his name and follow the below process:

a.The legal heir (LR) has to get a DSC in
his own name.

b.LH is required to make a request by sending a mail to ask@incometaxindia.gov.in mentioning the name, PAN,Date-of-Birth of deceased as well as that of the LH along with scanned attachment of the death certificate of the
deceased.

c.On receipt of above, LH would be enabled to file the return of deceased using LHs DSC.

11 September 2012 Sir,
When we quote PAN of deceased in return,there should be a mismatch of PAN between DECEASED AND DSC HOLDER(LH). HOW CAN OVERCOME THIS SIR?

11 September 2012 As mentioned above you have to write an e-mail to the income tax department and then there will be no problem.
