Is Service tax on rent of commercial property applicable as 0% and from which date?

06 May 2009 The ST on rent was being questioned on many counts., Now the Delhi HC has held that on count of the same not beeing a value added service not liable and that only services in realtion to rent are liable and those of rent not liable. The same maybe appealed in all probabality.

If paying the same maybe paid under protest.

06 May 2009 Pursunt to Delhi High Court decision on service tax no amendement has been carried so far by in finance Act, so the service tax still needs to be paid. However if someone stop paying so based upon the decision of the Delhi HC, if departmeent raises the query and demands service tax, an apeal can be filed against that order and the chances of wining the case in Delhi HC jurisdiction are very bright. This definitly will lead to litigation.
