Dear Expert,
Our Pvt Ltd Company in India in association with company in Taiwan, participated in a Exhibition held in India. The total fees for the exhibition was paid by the Taiwan Company and now our Company in India wants to reimburse 50% of the amount to Taiwan company as reimbursement of exhibition expenses. Now we want to take 15CB for remittance of amount. Whether TDS is applicable on this transaction? If yes at what rate and under which section.

TDS is very much applicable. section 195.

Was the Taiwan Company the Organiser of this exhibit? If not then the Taiwan Co. seems to incurred an business expense and your just reimbursing the expense. In which case TDS may not apply.

Here the issue may arise that whether Indian Company if had paid the sum directly to the other Indian Company(organiser),TDS u/s 194 I was applicable or not.
