25 March 2014 sir/mam please tell me is there any way to ask income tax department for refund of income tax without filling return.. as some one else used my pan and filled his return using my pan no. now i am unable to file my return and claim refund.. please help me in this regard

25 March 2014 How can someone file his return using your PAN as the name and DOB will mismatch? There is no way to claim refund without filing the return.

25 March 2014 sir, karta of huf filled his retuen using my huf pan. the fact is that I and other person who filled his return have same name. and ancestral dob was mentioned in PAN

20 July 2025 This is a tricky situation but here’s what you can do:

Rectify the duplicate PAN issue:
Since the Karta of the HUF used your PAN (or the HUF PAN) and filed a return, the Income Tax Department’s system is blocking your return due to PAN duplication.
File a rectification or clarification request:
You should write a detailed letter/email to your jurisdictional Assessing Officer (AO) explaining the situation:
Mention that the return filed under your PAN (or HUF PAN) was by another person (Karta of HUF with same name and DOB) mistakenly or fraudulently.
Request them to allow you to file your correct return and claim your refund.
Submit proof of identity and relationship:
Provide supporting documents such as PAN cards, Aadhaar, HUF deed (if applicable), and any other proof that establishes the difference.
Contact the Income Tax Helpline:
You can also call the Income Tax e-filing helpdesk and lodge a grievance explaining the issue.
Filing a revised return:
Once the AO allows, you may be able to file your return with the correct details and claim refund.
Important:
There is no provision to claim refund without filing an Income Tax Return (ITR). So resolving the PAN issue is the first step.
