16 January 2013 i am a civil contractor and tds deducted as per rules but some agency/govt. dept. did file tds return, only they are depositing tds in the bank.

when i asked them to file tds return they ignore my questions and tell what to do instead of tds return ?

then i realize that if i take that tds amount by cheque direct deposit in bank as advance tax, credit will seen in my 26AS statement.

but when i file income tax return,dept send refund only tds return filed amount not total amount !!

so, please kindly help me to collect available tds and also give suggestion for future

16 January 2013 As per IT Act every person who is deduct tds ,is liable to file their TDS return in prescribed time.If he failed to file his return in time.They attract penalty Rs.200/ per day from date of filling to date of actual filling .

16 January 2013 yes you are right,

but some small panchayat not even have tan no. so how can they file tds return ?

anyother solution because it is all over govt. dept not to file tds return

16 January 2013 Ask them to give you a TDS certificate Form 16A or proof of deposition of TDS in any form which you can show to Income Tax department.
