RE : Credit note

This query is : Resolved

Quick Summary
A business issued a GST invoice and paid the tax, but later had to cancel the service. They are asking if they can still issue a credit note, as the September 2020 deadline has passed. The expert suggests the receiver of the service should raise a tax invoice for the default and claim ITC, as the time limit for issuing a credit note has expired.

19 February 2021 Dear Expert,
We have raised a GST Invoice on 26.06.2019 and shown in GSTR-1 and paid the GST amount in the same month.. but later the service which we provided against the invoice was failed and it had to be cancelled..
Can we take credit note for the transaction and effect the same in GSTR portal ..

Kindly do the needful

20 February 2021 The time limit for issuing credit note is expired by September 2020.
Ask your receiver of service raise a tax invoice for default in service and pay for it and claim ITC.

22 February 2021 Thank you for the reply sir
