01 April 2014 Dear Sir/Ma'am,

My client has a duplicate DIN. He needs to surrender it.

Earlier to surrender DIN, a hard copy of the application for the same had to be send to the MCA DIN CELL, RD, Northern Region. But now since new rules has been notified, I came to know that the format of the application and procedure has been changed.

Kindly provide the new format and advise.

01 April 2014 Rule is silent on the issue. But,prescribed form DIR-5 for surrender of DIN which according to me can't be used for surrendering duplicate DIN.

01 April 2014 Dear Sir,

The application obtained for surrendering DIN is dated 25.03.2014. So would that be ok to proceed it as per the old procedure, by sending the hard copy to MCA DIN CELL.

02 April 2014 Dear Chakrapani Sir,

The rule speaks about Cancellation or surrender or Deactivation of DIN, but to be published in the gazette. Can you kindly explain why in you opinion the prescribed DIR-5 cannot be used for surrendering duplicate DIN.

10 August 2024 To surrender a duplicate Director Identification Number (DIN) as per the latest rules and procedures, you need to follow the updated process set by the Ministry of Corporate Affairs (MCA). Here’s a step-by-step guide based on the new rules:

### **Procedure for Surrendering Duplicate DIN**

#### **1. **Obtain the Latest DIR-5 Form:**
- **DIR-5** is the form prescribed by the MCA for the surrender of DIN. This form can be downloaded from the MCA website or accessed through the MCA's online portal.

#### **2. **Log In to the MCA Portal:**
- Visit the MCA portal (https://www.mca.gov.in) and log in using your credentials.

#### **3. **Fill Out Form DIR-5:**
- **Part A:** Provide details of the DIN(s) to be surrendered and specify the reason for surrender.
- **Part B:** Fill in the details of the director, including their personal information and contact details.
- **Part C:** Provide details of the DIN(s) being surrendered. Ensure to mention that the DIN is a duplicate.
- **Attachments:** Attach supporting documents such as an affidavit declaring that the DIN is duplicate and other necessary documents as specified in the form.

#### **4. **Certify the Form:**
- The form must be certified by a Company Secretary in Practice, Chartered Accountant, Cost Accountant, or by the Director of the company. This certification confirms that the details provided are correct and complete.

#### **5. **Submit the Form:**
- Submit the completed DIR-5 form online through the MCA portal. Ensure that the form is correctly filled and all attachments are included.

#### **6. **Acknowledge Receipt:**
- After submission, take note of the acknowledgement receipt or the SRN (Service Request Number) provided by the MCA portal. This serves as proof of submission.

#### **7. **Follow-Up (if necessary):**
- Monitor the status of the application through the MCA portal. If any additional information or documents are requested, provide them promptly.

### **Additional Considerations:**

- **Old Procedure vs. New Procedure:** If the application for surrendering the DIN is dated 25.03.2014, it’s recommended to follow the current procedure as per the latest rules, as the old procedure may no longer be valid. The new rules and forms supersede previous guidelines.

- **Gazette Notification:** The rule about publication in the Gazette is related to certain regulatory requirements but does not necessarily affect the DIN surrender process directly. The DIR-5 form is designed to facilitate the surrender process without needing a Gazette notification.

- **No Need for Hard Copy:** With the updated rules, the process is primarily online. The hard copy submission is generally not required if you are following the latest procedure.

- **DIN Cancellation Process:** The prescribed DIR-5 form can be used for surrendering duplicate DINs, and the process involves online submission rather than physical submission to the DIN Cell.

### **Sample Format for DIR-5 Application:**

**Form DIR-5** can be obtained from the MCA website. Ensure you use the latest version of the form. The format and instructions will be included in the form itself, which will guide you through the required fields and necessary attachments.

**Conclusion:**
Follow the online procedure using the DIR-5 form for the surrender of the duplicate DIN. Ensure that the form is accurately filled and submitted through the MCA portal. For any specific issues or if further clarification is needed, consider consulting with a professional or contacting the MCA helpdesk.
