13 December 2009 describe in brief how to purchase and sell a house property,flat or land? what happened to those original registry belonged to seller after purchase of property?does it kept by subregistrar/registrar?or we(purchaser) took all those original documents?..how to purchase a flat from a builder or development authority and how to do registry of it? does anyone can sell a house property without ownership on papers but withhold of papers belong to others?

13 December 2009 If conveyance deeds are registered in you name; it is sufficient proof that you are owner of that property.

However; for the sake of safety; it is general practice that original deed registered in the name of the seller is taken into the possession of the Buyer.

Original deeds are not kept by the Sub-registrar.

However; they have copies thereof for their records.

A person legally cannot sell the house property if he is not having title registered in his name.

WHAT IS THE PROCEDURE TO PURCHASE A FLAT FROM A BUILDER OF APARTMENT BUILDING? OR FROM A COOPERATIVE HOUSING SOCIETY? AND FROM A CITY DEVELOPMENT AUTHORITY..WHO IS THE SELLER PARTIES IN THESE CASES?

12 April 2010 1. Ask from the builder a Master File of the Flat. It will contain N.A. permission issued by Municipal Corporation, History of the Land and its previous owners, Copy of Plan and other necessary permissions. Ask him whether the master file is put before any of the bank. If yes, go to the bank and ask them how much loan is available on that flat. (Even if you don't wish to take loan - go to bank as told by the builder - to verify his statement). You can also refer the case to the Civil Advocate to test the Title Clearance of the Property. But only title clearnace is not enough. All the relevant facts should be tested with the help of master file.

2. When you purchase a flat through housing society; it allots you a Flat which you select and accordingly allotment letter is issued to you. There is separate agreement with the Developer who in turn develops the building (flats).

3. In case of city development authority; the same procedure is there as stated in 2 but here the developer is City Development Authority.

who will be the counter part in these cases and how to draft sale deed in this case? and if we dont know all these legal formalities then wat should we do to complete all this activities?
