I had completed my cafinal recently. 1 year back my articleship completed.I applied for membership.i had completed my distance 2nd and 3rd year degree after completion of articles.my 1st year degree 4days included in my articleship period...I got mail from Icai stating that I required to submit from112. Principle sign mandatory.. But my principal not accepting to make sign ..from one week onwards I was requesting him..3FCA also requested him regarding this sign...he is not at all accepting to sign...I don't know what to do ...What will I do to make sign on my from112.Any one please help me ...I am in dailama ...

This you should have thought when you actually kept your Principal in DARK. I fully agree with your Principal.... It is NOT the question of 4 or 5 days...It is the question of Principle. I rather appreciate the action of your Principal.
From your side, what you can do is......send the form 112 to ICAI, without your Principal's signature on it....Attach a letter to this form 112, stating that such and such things have happened. Pleasse be merciful in admitting you as member, with a positive assertion that hence forth you will take utmost care

Sir...may I know what is the problem for my principal make a sign on form 112.Icai stated that principal sign is mandatory retirement...without sign how can they accept sir..

First, accept for yourself and within yourself that you have committed a GRAVE mistake. Then you will start getting solution for the same. Also accept that your Principal has NOT at all committed any mistake....ok?
Next....See the logic goes like this......An articled clerk is duty bound to take prior permission of ICAI for doing ANY course along with pursuing articleship. It is presumed to be the primary RESPONSIBILITY of the articled to take permission and NOT that of Principal. Ok?
As a matter of fact, so long as the timing of such a course is NOT clashing with the timings of the office timings of Principal, Principal is NOT supposed to probe into any enquiry as to what his/her articled is doing outside his/her office. So? The responsibility is that of YOURS and not your principal. Ok?
You are asking your Principal to sign.....If your Principal signs, it will INDIRECTLY suggest that your PRINCIPAL was also a party in your wrong DEED.
My advice would be : You have done a wrong by yourself....(may be knowingly or unknowingly)...Go ahead....write a letter to ICAI, requesting (A). to Condone delay in submitting form 112 (B).to Accept the form without the signature of Principal (C) to assure that you will be cautious in NOT committing such things in your tenure as member etc etc...
