A patent is needed for products that are bought and sold in India, especially by those who want to protect their work from infringement by others. India is similar to the United States in that they grant patents on products that do not currently exist and reject patents on existing products. Those who want to apply for a patent in India will find the process quite easy because they can complete the entire process online with the government of India website

Search for patents already in existence. India is like other countries in that they won't grant patents on products that have already been registered. This step will save you time and prevent you from filling out the long application on something that already exists.

Ensure that the patent is for an invention that falls under the general criteria used in India. The country requires that patents be for something that falls under the natural laws, is new, fits industry applications, and it should be something that the average person could not think of on their own.

Register for a new account on the government of India website. You'll want to click on the link labeled eFilling of Patent Application on the left hand side of the screen. This takes you to a new website where you'll register. Log in to the website and download the client software found on the site.

Complete the patent application file, and save it as an XML file with the software. Sign the finished file and upload the completed packet on the website. Then, you'll want to pay the fee associated with registering a patent in India. This sounds fairly complicated, but you'll find step-by-step instructions in the file.

Check the application status on the website to ensure that everything was uploaded properly. When the packet is accepted, a new screen will appear with the acknowledgment paperwork. Print out this page, and wait for the patent to be accepted. Rather than sending an email, you'll need to log back into the system and wait for your approval to come through
