14 January 2011 The question before me is with American PAN of a non resident, can we deduct TDS at DTAA rates instead of 20%. Though i can answer no, how to substantiate my answer? The non resident has no Indian PAN.

14 January 2011 For the purpose of Chapter XVIIB, PAN obtained under section 139A of the Incometax Act,1961 is a must.

12 March 2011 The answer is NO in terms of section 206AA.
