15 October 2018 Dear sir,

We are paying salary to NRI Employee by India.we are calculating Income Tax Rate of India and we have investment declaration of these employee's.They have no PAN of India.How to submit TDS Return and how to give form 16.is it right?please clear this issue.

15 October 2018 The salary is paid to NRI employee working outside India and salary is paid in foreign currency. That payment is not taxable in India hence no TDS deducted in India.

16 October 2018 if we apply pan no of NRI of india,we can deduct Income Tax.

16 October 2018 Salary earned outside India why TDS in India. Deduct TDS applicable at the country of payment.

17 October 2018 Tax payable in the country where income is earned and based on residential status of the country. TDS provisions of that country is applicable. No TDS need to be deducted in India.
