dear sir
a notice has been received that Assessee claiming more income U/S 44AD as compared to gross receipt in ITR 4S. and required to rectified return with in 15 days. i have file the return for rs 202300 for A.Y. 2012-13, please tell me what to do now to rectify the return.

you claimed less income or more?? because there is no restriction on claiming more income.

strange as 44ad provides for claiming higher income.

ya, it is. but now i m going to claim same income again by applying assessment u/s 143(1)first,

the problem is that how do you apply 143(1) if return itself is being considered defective!! it will become non-est if the defect (which according to us is not a defect) is corrected within 15 days.

as per notice if return is not get correct, it is deemed as non submission of original return, now do i need to resubmit same return with same income again?
