I have a query regarding income tax.There is a CA filing my father's IT return from last 4 or 5 year.When i checked the acknowledgment i came to know that he was filing the return as business profession income but my father is a salaried person , so can i now file his return in salary head or i have to do something else for this...... Please suggest....

01 February 2012 First you approach your CA(income tax return filling ca) and asked him why he shows as business or profession income and then depending on the facts discuss with him about your query my suggestion is better to consult the CA and take his decision and suggestion.

02 February 2012 thanks Mr Tirumala but he has left jaipur now & i have no contact details of him.I met with some other people also whose return was filed by him....It was totally mess he was doing with his client.....

Now please suggest is there any way i can change it out or i should continue with the B&P income

03 February 2012 If you have all the evidences to prove it is salary income then you can change the head of income now. But depending on the facts i will confirm you the proper head let the salary or remunaretion what ever may be received by the partner in a firm is liable to business income that way some of the salary may be liable for business income. If the relation between your father and the salary paying person is employee and employer relationship only then un-doubtaedly you can claim as SALARY income. By the explanation you can confident and cleared your doubt then you follow my suggestion otherwise better to approach any CA he can suggest you depending on the fact. Without knowing the facts we can't do so......
But Maximum cases no problem earises due to the change of the head by the logical thinking a business or professional can change to job and vise-versa or any other so due to the changing of the head of income doesn't earises any problem but you have to evidence to prove in-case of any scrutiny assessment.
