Kindly clarify and confirm is there is any Rule/ Notifications,for claim "National Holiday"?. Here is One of our Vendor claiming "Natioanl Holiday" for their employees only if employees worked on very previous day and very next day of the Natioanl Holiday.If they not worked that particular days, they are not claiming "National Holiday". Whether this method is correct as per Labour Law or Not?

Prima facie, the contention of VENDOR is correct. National holiday ... please refer to any nearby nationalised bank in your state. It will be displaying the national holidays of that state.

The agreement between the vendor and the company is of crucial importance. Unless otherwise specifically mentioned otherwise, the vendor's claim is prima facie acceptable as per Indian law. The position may change from case to case. In many Indian companies of providing contract labour...... national holiday is to be taken care of by the labour supplier i.e service provider and NOT by service receiver... even under LABOUR law.
