21 January 2015 Dear Experts,
I am making a Application for reservation of name in Form INC-1, Its a private limited company.. having two promoters.

The proposed name of the company is i,e

"Planet Healthcare pvt ltd", "Planet Health Facility Pvt Ltd." etc. and these 2 promoters(husband n wife) have 4 more companies with prefix "Planet" with the other business activities so my query is there any more requirements needs to be file with ROC in form INC.. any other information required.???
OR details like these directors are also directors in such other 4-5 companies (containing the name Planet like that..???

I hope you will find the query in order. Please suggest me regarding INC -1??

21 January 2015 Attach copy of the No Objection Certificate by way of Board resolution from 4 companies (Duly attested by a Director of that company)FOR USING WORD PLANET

IF THE WORD PLANET IS THE REGISTERED TRADE MARK, YOU HAVE TO ATTACH TRADE MARK CERTIFICATE

22 January 2015 NOC required from all the companies in which these promoters are already a director and promoters???

22 January 2015 it is not relevant whether these promoter are promoter or director in other companies.

NOC is related to using of word Planet. hence companies using "Planet" word need to give NOC to proposed new company so that new company can use the word Planet irrespective whether the promoters and directors of other 4 companies are proposed to be promoter and director

but there are many companies using word "Planet" so i should required to obtain NOC from all these companies???
and these 4-5 companies which are also with the word planet having only these two directors who are going to incorporate one more new company with the word planet but with the other business activities

22 January 2015 In case the name is similar to any existing company or to the foreign holding company, you have specify name of such company and
also attach copy of the No Objection Certificate by way of Board resolution (Duly attested by a Director of that company)

for eg. if proposed name of the company is Planet services Pvt. Ltd and is a registered trade mark of that class of other company then you have obtain consent from that other companies

e.g Planet is a registered trade mark in musical instrument if you want to incoporate company with the name planet in muscial instrument then you have to obtain approval from the owner of that trademark and NOC from all companies say group companies of owner of trademark "planet" for using the word planet
