Liability to file a return.

19 April 2012 A minor child have received an amount of nearabt 10 lakhs on behalf of his dead father.now the child is alone in this family as his mother have already expired.He is under the custody of a gaurdian and the cheque received is in the name of minor child.
Now who is liable to file return and pay tax on the amount received by the minor.

21 April 2012 The minor's income, in case both the parents are not alive, cannot be assessed in the hands of grandparent or any other relatives or even in the hands of minor- R.P. Sarathy V. CIT [2006] 5 SOT 732 (Chennai).
