A lady who is NOT a pathologist owns a pathology lab...she receives monthly payments from a hospital for the services rendered to patients admitted in their hospital which totals around 38 lacs... the hospital deducts tds u/s 194J.
Lab employs pathologist and other technicians.
Now i want to know whether the lady ll be treated as professional under IT Act and liable to tax audit.
Please try to corroborate your answer if possible.

yes... she will be treated as professional as she is providing professional services. It is not necessary that she should posses any professional degree....please refer explanation to section 194J

The pathological laboratory is a business and not profession.
