Intimation under section 143 (1)

13 February 2012 one of my client has received intimation under section 134(1) for A Y 2009-10.Background of the case is as follows.

1. my client has two pan no

2. return filed on pan no 1

3. however TDS claimed on salary as per 26AS is given for pan no 2 [ as pan no 2 was furnished to employer ].

4. intimation raising demand issued against pan 1 [ this is because, no tds is available on pan 1 under 26AS ]

5. I have filed rectification under 154 to ITO, clarifying the situation along with pan copies and tds certificate. ITO has not yet passed any order.

6. our application for cancellation of Pan No 1, is rejected by ITO.

My query is, what should i do in this case. I can not file revised return as time limit has already elapsed.

13 February 2012 If you can get rectified PAN in E-tds return then chances of getting refund become clearer. Get Cancelled the PAN 2.

But how can i get rectified PAN in E TDS return. Employer is not willing to file revised tds return.
