27 July 2011 Sir,

My uncle filed his return in 2002-03. Then he had not filed return and in this year he has filled the return and claimed TDS. Will there be any problem in getting TDS? And what is the procedure if he wants to file earlier year's return?

27 July 2011 There will not be any problems in getting refund of TDS. No need to file the return of earlier years as they were must have been NIl returns. Also the date of filing has long expired.

27 July 2011 Refund will be issued if it is legitimately due to your uncle irrespective of the earlier year's lapse of not filing the return. He can file the return for the financial year 2009-10 also ,voluntarily, if he so wish. Beyond that return can't be filed being barred by time.

27 July 2011 If the income of your uncle is below taxable income in fin. 2003 onwards till the fin. year 2009 - 10 then there is no problem. he can file his IT return for the fin. year 2010-11 and can claim TDS . However he can also file IT return for the fin. Year 2009 -10 as a belated return.
