05 March 2018 An assesee is an Indian Origin but is not fulfilling the condition of 182 days of staying in India. So the income earned
from Dubai is Taxable? Since Dubai is tax free country so Income from Dubai will be taxable in India or not? And also whether the assessee has to file his return

05 March 2018 If he doesn't satisfy 182 days stay in the previous year, did he also satisfy the second condition i.e stayed 60 days or more in the previous year and 365 days or more in the 4 years immediately preceding the previous year?

If he doesn't satisfy both, then he is a non resident and the income from Dubai is not taxable

05 March 2018 If he satisfies the above condition, then he is a resident (ordinarily or not ordinarily resident) and the Income from dubai is taxable here.

05 March 2018 That an income is tax free in Dubai doesnt mean that the income will be tax free here too. It depends on the residential status of the assessee

05 March 2018 Needs to file a return if the Gross Income, before any deductions, exceeds minimum amount not chargeable to tax
