from where i can know the definition of sand lime bricks as specified in Harmonized System of Nomenclature?

Sand-Lime Bricks : Flyash-sand-lime bricks are manufactured by mixing flyash sand and lime in 70-80 %, 0-10 % and 8-20 %, respectively, proportions which may be followed by addition of 0.2-0.3 % chemical accelerator during wet mixing. This mixture is moulded under 80-240 kg/cm2 pressure. The green bricks can be air cured for 24-48 hours and then hot water / steam cured or autoclaved at 1-14 kg/cm2 pressure and 100-1800 C temperature for 3-12 hours. Some of the organizations which offer this know-how are NCB, CBRI, CFRI, ACC, SAIL, etc..

sir, we are presently manufacturing the bricks using above mix ratio. i want to confirm that can above mix of bricks is eligible for excise exemption notification dated 01.04.2011 for sand lime bricks excisable at the rate of 1% excise duty?

It appears that bricks in your case falls under chapter and heading 6904 10 00 i.e. building bricks not falling under other specified category and in respect of same you can take benefit of above said notification.

sir, our bricks do not falls under chapter 69 as chapter note 1 of this chapter says that this chapter applies to ceremic products which have been fired after shaping. But our bricks are sundried after shaping. we are confused for the above notification.......
please confirm that our bricks can be classified as sandlime bricks under EN/N 01/2011.

but sir our bricks are not refrecatory bricks as these are sundried only........ no any fire process is use to apply on it.

I agreed with CA Priyanka and according to me as bricks in your case not shown in schedule 1 or 2 then it is not exciseable good. For precaution you may confirm the same by writing letter to the concerned range superintendent of excise.

Punit Sir, we went in appeal earlier for the above fact but our appeal was rejected by CCE(A) and was held excisable product under tariff heading 68159910. now i want to confirm wheather our product is eligible for E/N 01/2011 for 1%..............

@ CA priyanka. Yes excise department is right and sand lime bricks is covered by entry no 78 of above notification and accordingly. u can pay excise duty on same @ 1%
