one trader get cliams for sale of mobile hanset as a incentives but the maharashtra sales tax department says it is sale because u get it handset at discounted price so my question is whether this type of incentives are sales and whether i have to pay sales tax on that claims/insentives

Whats material is who is raising the invoice. If trader is raising the invoice then he has to pay the sales tax.
