Gst on fully paid vat property

01 September 2017 I purchased flat in year 2015 in Navi Mumbai, Maharashtra. Flat was registered same year and 1% VAT on total agreement value also paid on same time. Before gst 95% work got completed and I paid builder 95% of flat value+ service tax. Now remaining work is completed and developer is asking remaining 5 % amount + 12 % gst on outstanding. My query is do I need to pay gst on remaining amount as I already paid VAT on full agreement value. Please guide me in this.

01 September 2017 You need to pay GST in case of any consideration paid to the builder before issue of completion certificate or first occupation whichever is earlier..

02 September 2017 Builder received Cc and OC. If I have to pay GST what about VAT which was paid on whole flat value. Will I get some kind of return.

06 September 2017 If consideration paid after CC and OC no GST payable.In case consideration was paid before CCand OC you can avail credit of Vat paid on portion of work completed post GST (Refer Section 142((11)(c) of CGST Act). For claiming such credit fill in TRAN 1 within 28 September.
